the Ministry of Education and Science of the Slovak Republic

 

of September 7, 1993

 

whereby the details are set up on equivalence of certificates and on conditions of recognition of equivalence of certificates issued by foreign primary and secondary schools

 

In accord with §15 Section 2 of the Act of the Slovak National Council No. 542/1990 of Law Code on State Administration in Education and Regional Offices, the Ministry of Education and Science of the Slovak Republic sets up:

 

 §1

Basic Provisions

 

This Decree lays down the details on equivalence of certificates and on conditions of recognition of equivalence of certificates issued by foreign primary and secondary schools.

 

§ 2

Recognition of Equivalence of Certificates

 

1/ The certificates issued by a foreign school of the State with which an agreement was concluded on mutual recognition of equivalence of certificates whereby the Slovak Republic is bound, shall be recognized to be equivalent without nostrification.

2/ The graduate of a foreign school shall apply the regional office appropriate according to his place of residence for an issue of a certificate on equivalence of certificates. The application shall be attached a document shown in § 3, Section 4, letter a) translated into the Slovak language and verified according to § 3, Section 6, of this Decree.

3/ The regional office1) shall issue within 15 days from delivery of the application, a document that will show the document with which the submitted document is equivalent.

 

§ 3

Nostrification of Certificates

 

1/ Nostrification is recognition of validity of certificates on school-leaving examination, final examination, absolutorium or other professional examination or recognition of validity of final certificate issued by a foreign school in the Slovak Republic.

2/ Only a certificate on completed education is subject of nostrification.

3/ The subject of nostrification shall be a certificate issued by a foreign institution, which is comparable by its concentration and curricula to the primary school or which corresponds to the study of the same or relative field of study or apprenticeship at a secondary school.

4/ The graduate of a foreign school shall attach to the application on nostrification:

a/ a verified copy of certificate on completion of primary school, if it represents nostrification of a certificate on its completion, on a school-leaving examination or a final examination or on absolutorium or other professional examination,

b/ unless the document under letter a) directly shows successful completion of the entire study, a verified list of subjects with the number of teaching hours in individual years of study (curricula),

c/ a document of the foreign school on the extent of practical teaching if it is a profiling component of education and is not shown in curricula.

5/ The application for nostrification is further attached a verified translation of document on education issued by the foreign school and of documents shown in Section 4 issued by the foreign institution into Slovak language.

6/ Authenticity of signatures and stamp of school on original documents shown in Section 4, letter a) must be verified by the state authority responsible for its verification or by notary in the appropriate State with an imprint of the stamp of the representative office of the Slovak Republic in that State, unless stated otherwise by the international agreement.

 

§ 4

Supplementary Examination

 

1/ Supplementary examination is meant to verify the knowledge and skills of graduate in subjects or in their parts, unless the graduate was given marks for them at the foreign school, and having a direct relation to the graduate’s profil, the field of study or the branch of apprenticeship pursued, in case that

a/ the study at the foreign school only partially corresponds to the curricula at primary school or to the study in the relative field of study or branch of apprenticeship in secondary school,

b/ the graduate did not attach all the documents shown in § 3, Section 4, letters b) and c).

2/ The graduate who is not a national of the Slovak Republic, shall not take a supplementary examination in Slovak language and literature.

3/ The regional office shall determine the primary school or secondary school in which the graduate shall take the supplementary examination, the content and the date of examination; if they are the schools of which it is not a founder, it cooperates with founders of the schools.

4/ The supplementary examination is held before the examination commission. The commission consists of three members, at least. The chairman and other members of the commission are appointed by the regional office director.

5/ The results of the supplementary examination are decided by the commission through voting. At equality of voices the vote of the chairperson of the commission is decisive.

6/ The commission shall prepare a record on the supplementary examination.

 

§5 Common and Final Provisions

 

1/ The document on education that is not a subject of nostrification is valid since the date of issue of the document; the document that is a subject of nostrification is valid since the date of validity of the decision on nostrification.

2/ The nostrification of the document on education issued by a foreign school is charged a fee according to special prescriptions.2)

 

§ 6 The decree No. 41/1981 of the Law Code whereby the details on equality and on conditions of recognition of certificates on school-leaving examination issued by foreign schools, are invalidated.

 

§ 7 Validity

 

This Decree shall come into force as at October 1, 1993.

DECREE

No. 79/1993 of Law Code

of the Ministry of Economy of the Slovak Republic

of February 3, 1993

on Acquisition of Professional Competence of Fireworkers and Pyrotechnicians

 

The Ministry of Economy of the Slovak Republic (hereinafter the "Ministry") in accord with § 36 Section 7 of the Act of the Slovak National Council No. 51/1988 of Law Code on Mining Activities, Explosives and on State Mining Administration, as amended by the Act of the Slovak National Council No. 499/1991 of Law Code, sets up:

§ 1

 

1/ Theoretical and practical teaching of applicants of a fireworker or pyrotechnician authorization is usually carried on in weekly courses twice in a year. The scope and curricula are shown in Appendices 1 and 2 of the Decree.

2/ The application for the course is subject of submission by the applicant’s employer to the Ministry. If the applicant is not employed, the application form is submitted by the applicant himself.

3/ The application form consists of:

a/ name, date and place of birth, number of birth-certificate and permanent place of residence of the applicant,

b/ name and address of the employer, profession and the kind of the work performed by the applicant.

4/ The application is attached:

a/ a verification on acquisition of professional qualification for works with explosives (only in case of application for pyrotechnician’s courses), and data on previous experience in works with explosives,

b/ a certificate of the state health administration body on health competence of applicant.

c) a certificate on having clean records. 2)

1/ § 3, Section 3 of the Decree of the Ministry of Economy of the Slovak Republic No. 78/1993 of Law Code whereby the requirements on the provision of security and health protection at production and processing of explosives are set up.

§ 2

 

1/ Professional competence shall be verified by an examination taken before the examination commission and proved by a certificate.

2/ The examination commission is appointed by the Ministry upon the proposal of the head of the organization entrusted with teaching. The commission is composed of three members at least. Its chairman is a representative of the Ministry. The result of the examination is decided by the commission through voting.

3/ The examination consists of three parts: written, oral and practical.

4/ The result of each part of examination is evaluated individually by grades "pass" or "fail". If the applicant fails in the written part of the examination, he is not allowed to continue in further parts of the examination.

5/ The overall result of the examination is evaluated by grades "pass" or "fail".

6/ In case of equality of votes given by members of the commission, the chairman’s vote is decisive.

 

§ 3

 

1/ If the applicant fails in examination he may re-sit without repeating the course, within six weeks at the earliest and one year at the latest, after the fail.

 

2/ The date and scope of the second examination is set up by the examination commission as a rule on the day of taking the regular examination.

3/ The applicant may re-sit as shown under Section 1 twice at most.

4/ If the applicant also fails at the second re-sit or if he does not re-sit within the set up date shown under Section 1, the next examination may be taken only on the basis of the new application and upon completing the course.

 

1/ On the basis of successful completion of examination the fireworker is issued:

a/ a certificate on professional competence,

b/ a fireworker certificate that authorizes its holder to perform the function of a fireworker.

 

2/ The fireworker’s certificate is valid for five years. After expiry of the certificate the holder may ask for prolongation by another five years upon submission of:

a/ a certificate of the state health administration body on health competence to perform the function of fireworker,

b/ a certificate on performance or management of fireworks issued by the appropriate district mining office.

 

3/ In case that the holder of the certificate on qualification has not performed or managed the fireworks during five years, he must be examined in theoretical and practical knowledge according to § 2. If he does not re-sit for examinations, the validity of his certificate expires.

 

§ 5

 

1/ On the basis of successful completion of examination the pyrotechnician is issued:

a/ a certificate on professional competence,

b/ a certificate of pyrotechnician that authorizes its holder to perform the function of a pyrotechnician.

2/ There are the following kinds of pyrotechnician’s certificates:

a/ pyrotechnician - blaster group A

b/ pyrotechnician - head blaster group B

c/ pyrotechnician group C

 

 

The scope of authorization of pyrotechnician group A to C is shown in Appendix 3 of this Decree.

 

3/ The certificate of pyrotechnician groups A to C is valid for three years. After expiry he may ask for prolongation by another three years upon submission of:

a/ a certificate of the state health administration body on health competence to perform the function of pyrotechnician,

b/ a certificate on performance or management of activities within the scope of authorization given by the pyrotechnician’s certificate.

 

4/ In case that the holder of the pyrotechnician’s certificate of groups A to C has not performed the activities during three years he ought to be examined in theoretical and practical skills according to § 2.

5/ A successful result in second examination is entered in the pyrotechnician’s certificate. In case of failure, § 3 is applied.

6/ If the holder of the pyrotechnician’s certificate of groups A to C does not re-sit for exams according section 4, the validity of his certificate expires.

7/ If the holder of the pyrotechnician’s certificate group A wants to receive an authorization of group B, he ought to be examined in theoretical and practical knowledge according to § 2.

 

§ 6

 

The costs for provision of the course and completion of examination of fireworker or pyrotechnician are covered by the sending organization or the applicant himself (§ 1, section 2).

 

§ 7

 

1/ The fireworker’s certificates issued before the date of operation of this Decree are valid by September 30, 1993.

2/ The pyrotechnician’s certificate issued before the date of operation of this Decree (according to a special prescription)3) are valid by September 30, 1993.

 

§ 8

 

This Decree shall come into force on the day of its promulgation.
